嚴重抗議三月九日民政總署動物檢疫處處長徐裕輝在新聞節目內講述有關防止虐畜法時道
「...香港與澳門法制不同...法規未必適用於澳門...法規需要全民共識才可立法...立法未係時候...」

雖然未知徐處長當日是代表其個人或代表民政總署而發言,但想反問徐處長的是:虐畜就是虐畜,有甚麼港澳兩地的所謂不同之處!不同的就是「澳門仍未有完善的法規去處理這些問題」。

難道在香港殺貓狗就是虐畜,在澳門則是家常便飯?
大家都知道擁有立法職能的機構是立法局、而非民政總署,那麼徐處長憑什麼向外界發表這些不負責任的言論呢?
還是他當日只是順口開河?
在澳門特區政府還未對有關法例進行研究及商討之前,徐處長就對傳媒發表「不適合」的言論,難道徐處長認為自己的職權可以代表澳門特區政府及立法局發表意見?
如果上述的種種疑問屬實, 那麼我們也只好相信訂定關於虐畜刑事化是「不適合」澳門,而且「未係時候」

如果認為將虐畜行為立法尚未是時候,那麼還要犧牲多少隻不幸的寵物屍體、還要陸續出現多少個殘暴青少年、還要出現多少天的報紙頭條,才是真正需要立法的時候呢?
澳門近年發展迅速,在各方面均足以成為一個國際性的城市,但卻發生了這些不人道的事件,而這事件僅是眾多個案中的冰山一角!更可悲的是,有關部門在訂定虐畜法例的進度中停滯不前兼嚴重落伍,就如同發出「不適合,未係時候」這些言論的官員一樣。這些人和事除了不能協助澳門更進一步之餘,更對澳門造成一定的阻礙!

另外我們從當天的報導中得知,原來法律需要「全民共識」才可立法,那麼去年在眾多市民反對下通過的<新道路法典>又是如何立法的呢?如果所有法律都需要「全民共識」才可立法,那麼相信澳門現行法例中,沒有一條「係時候」了。

青少年今天以殺害貓狗為樂,毫無悔意之餘更不用負上任何責任。而一名動物檢疫處處長的不負責任言論,可能助長這種不良風氣蔓延,令虐畜情況加劇。愛護動物應是一件無國界的事,但今天「澳門動物」被人如此冷漠對待,AAPAM也明白立法並非一朝一夕的事,但卻無法忍受以一句「未係時候」就推翻所有愛護動物人士的努力及立法的可能性。

希望發表言論的處長對他當天不負責任的言行負責,不論他的言論是代表個人、代表所屬部門還是代表特區政府!

Protest strongly at Mr. Xu Yu Hui (translation) of ICAM, Division Head of Veterinary Inspection and Control of Macau on 9th of March responses at the programme of TDM Macau. He pointed out that legislature for cruelty to animals in Hong Kong is different from that of Macau which might not be applicable locally; in order to legislate there is a need for consent by the general public and also it might not yet be the right timing for legislature.

We would like to ask did Mr. Xu expressed these opinions on behalf of ICAM or of his own. If that is his own opinion, we would like to know what is the difference between cruelty of Animals in different places! The difference is that there is no proper law in Macau to take care of this problem. Isn't it true that Mr. Xu agreed that killing dogs and cat in Hong Kong is accepted as cruelty to animals but if that happen in Macau is just nothing important? Since it is not ICAM to decide on setting up any criminal law why would Mr. Xu just casually respond on this issue! Or is his superior who wanted him to express such an irresponsible opinion! Why is it that even before the Macau SAR government has a chance to take this into discussion and analyze, Mr. Xu already expressed his misleading opinion in the public media. Isn't it true that Mr. Xu believed that he could represent the Macau SAR government or the Legislative Council to announce these responds? If that is the case, we no longer need the Undersecretary of Administration and Justice or the Legislative Assembly to discuss the relevant laws and regulation, rather just to ask Mr. Xu as he had already pronounced to the public that legislature for cruelty to animals is not suitable in Macau as well as is not the right time to do so!

We further question if Mr. Xu is accepting the situation of violence to animals to go on in Macau, isn't it that when there are more happenings of cruelty and killing of animals then is the right timing to start to legislate? It is difficult to understand the meaning of the expression of "not the right timing" by Mr. Xu, it lead to the doubt to ask when is the right timing then? Under the fast growing pace, Macau is an international city but we are so behind in terms of having regulation to protect animal against cruelty. It is difficult to believe that being the Division Head, Mr. Xu is being so backward and could not help Macau to take a leap forward but on the contrary act as a barrier for improvement.

Mr. Xu also mentioned that it would be necessary for having total public consent before it can be legislated. Then why would the Road Traffic Law be executed even before getting a public consent, as this can be seen from the public street demonstration against the Road Traffic Law after it was announced to be executed! As the Road Traffic Law still consist of problem does it sound like your term as "not the right time"?

We hope that Mr. Xu would understand that his opinions do not represent the facts. And once again, does his speech represented those of ICAM? And his personal opinion could not judge whether it is proper to have legislature or not. Being an official, you are be responsible to yourself, to your related department as well as the general public on any of your publicly expressed opinions. Today, just as a division head that your speech already took over the position of the Macau SAR government.... the next day when you are promoted to higher ranking.. more exotic speech could be expected!
